Getting a divorce is more simple than you think. You can make an application for divorce after you have been separated for twelve months. This can even include time in which you have been separated under one roof for example sleeping in separate beds.
DIY Divorce
The process for getting a divorce is simple when compared with other areas of family law. While most people use the term “divorce lawyer”, we encourage you to undertake this process on your own. Spend your money on more important issues such as parenting and property issues. There is a very helpful Do-It-Yourself kit published online by the Federal Circuit Court (http://www.federalcircuitcourt.gov.au). Click here to download the kit. You can apply together, or one party can make the application on their own. You will need a copy of your marriage certificate. The filing fee for a divorce is quite expensive, but if you hold a Centrelink or Health Care Card, the fee is significantly reduced.
Whilst we encourage you to do this application yourself, as it will save you a significant amount of money, we remain willing to make the application for you. You must keep in mind that you have a further twelve months after your divorce becomes final to make an application for a property settlement.
